This brief argues that a Maryland father’s HIV status and occasional temporary illness are not proper grounds to award custody to the children’s grandmother who took care of the children during his hospital stay. The courts previous ruling to take away custody constitutes a violation of the Americans with Disabilities Act and ignores established facts about individuals living with HIV.
