Case representing HIV positive man denied kidney transplant.

Lambda Legal represented John Carl, a Denver-area man who was denied a kidney transplant by Kaiser Permanente because he has HIV. The HMO reversed course after reviewing a range of scientific data on HIV and transplants and information about Carl’s personal health history.

    • September 2003 Lambda Legal files a formal appeal with Kaiser Permanente, asking the HMO to reverse its denial in light of a range of scientific data and Carl's personal health history and experience.
    • October 2003 Kaiser Permanente announces that it has reconsidered its initial rejection of a kidney transplant and will now cover the procedure.
