“I know how hurtful a law like this is to all kids like me who just want to play sports with their classmates, and I’m doing this for them. Trans kids deserve better.”

B.P.J. v. West Virginia State Board of Education is a lawsuit brought by and on behalf of then 11-year-old, now 15-year old Becky Pepper-Jackson. Becky comes from a family of avid runners and was looking forward to trying out for the girls’ cross-country team as she prepared to start middle school when Gov. Jim Justice signed HB 3293 into law.  H.B. 3293 bans girls and women who are transgender from participating in school sports.

Now in front of the Supreme Court, Becky’s case argues that the ban violates the rights of transgender and cisgender female students under the Equal Protection Clause of the Fourteenth Amendment of the U.S. Constitution as well as Title IX, the federal law prohibiting sex discrimination in educational programs.

As we wait for a decision, Lambda Legal could not be more proud to fight for her and all trans youth who just want a chance to play and be part of a team. Find resources and ways to support transgender youth below.
