
De la Fuente Díaz v. González Colón
In 2025, Lambda Legal joined the appeal on behalf of six nonbinary plaintiffs seeking to uphold the decision by the U.S. District Court of Puerto Rico decreeing that Puerto Rico’s denial of issuing accurate birth certificates to nonbinary people with an “X” gender marker violates the U.S. Constitution’s Equal Protection Clause.
- October 2023: The case was filed on behalf of six nonbinary plaintiffs seeking an accurate birth certificate with an “X” gender marker, represented by attorney Emmanuelli Huertas. The plaintiffs won at the District Court for Puerto Rico, upholding that Puerto Rico’s denial was unconstitutional.
- May 2025: The U.S. District Court for Puerto Rico granted summary judgment for the plaintiffs holding that Puerto Rico’s denial of an “X” gender marker was unconstitutional under the Equal Protection Clause.
- June 2025: The Puerto Rico government filed a notice of appeal to the U.S. Court of Appeals for the First Circuit.
- October 2025: Lambda Legal joins the case as co-counsel.
- April 2026: The U.S. Court of Appeals for the First Circuit held oral argument.
