Lambda Legal and the Human Rights Campaign Foundation today urged the United States Supreme Court to reject an effort by the Trump Administration to stay the preliminary injunction that blocks enforcement of the executive order and related guidance banning transgender people from enlisting or continuing to serve openly in the military.
Lambda Legal and the Human Rights Campaign Foundation issued the following statement:
“Let’s be clear about an undeniable truth: transgender servicemembers have earned their place in our military through hard work, dedication, sacrifice, and merit. And as the lower court found, the administration cannot demonstrate that continuing to allow patriotic and selfless transgender troops to serve our country diminishes our military in any way. Instead, any attempt to sideline them through this ban not only violates their constitutional rights but weakens our military’s readiness, lethality, and unit cohesion. We urge the court to deny the Trump administration’s request to reinstate the discriminatory ban.”
On March 27, a federal district court blocked enforcement of the Trump administration’s executive order banning transgender people from enlisting or continuing to serve in the military. The nationwide injunction applies to not only the lawsuit’s plaintiffs but also any similarly situated individuals, including servicemembers serving outside the United States. On March 28, the Trump Administration filed an emergency motion with the U.S. Court of Appeals for the Ninth Circuit seeking to stay the preliminary injunction, which was denied on April 18. In an April 24 filing, the Trump Administration asked the Supreme Court for an emergency stay of the preliminary injunction in order to allow them to begin implementing their executive order banning transgender people from enlisting or continuing to serve in the military to take effect.
