
Shilling v. United States
Lambda Legal, the Human Rights Campaign Foundation, and Perkins Coie filed this case in the U.S. District Court for the Western District of Washington. We are challenging the Trump Administration’s executive order banning transgender people from serving in the U.S. military. We represent six actively serving transgender service members who have between them close to a century of honorable service, a transgender person seeking to enlist, and Gender Justice League, a civil and human rights organization based in Seattle.
The executive order, titled “Prioritizing Military Excellence and Readiness,” and the so-called “Hegseth Policy” issued by the Department of Defense do not reflect military necessity. They reflect discrimination. Thousands of transgender service members have met the military’s rigorous standards and served with distinction, yet this ban strips them of their careers and blocks other qualified Americans from enlisting simply because of who they are. We argue the ban violates the constitutional guarantee of equal protection, the Fifth Amendment’s due process protections, the right to free speech, and that it violates equitable estoppel principles.
In March 2025, the trial court blocked the ban nationwide. The Ninth Circuit upheld that ruling, but the U.S. Supreme Court allowed the ban to take effect while the legal challenge proceeds. In October 2025, we argued before the Ninth Circuit that the injunction should be restored. We are now awaiting that ruling while simultaneously preparing for trial, currently scheduled to take place in November 2026.

- January 27, 2025: President Trump issues an executive order banning transgender service members from serving in the United States Armed Forces.
- February 6, 2025: Lambda Legal, the Human Rights Campaign Foundation, and Perkins Coie file suit, arguing the ban is unconstitutional and harms thousands of qualified service members.
- March 27, 2025: A federal judge issues a nationwide preliminary injunction blocking the ban. Transgender service members can continue serving while the case proceeds.
- March 28, 2025: The government appeals to the Ninth Circuit, and asks that the ban stay in force during the appeals process.
- March 31, 2025: The Ninth Circuit temporarily allows the ban to stay in effect while it decides whether to keep the ban in place during the appeals process.
- April 4, 2025: The government asks the U.S. Supreme Court to keep transgender service members out of the military during the appeals process.
- April 18, 2025: The Ninth Circuit denies the government’s request, keeping the injunction in place and protecting transgender service members’ ability to continue serving.
- May 5, 2025: The Supreme Court allows the ban to go back into effect while the case continues. Transgender service members once again face discharge, and new recruits are turned away.
- May 23, 2025: Plaintiffs file brief at the Ninth Circuit urging the court to restore the block on the ban and protect transgender service members’ right to remain in the military.
- October 20, 2025: The Ninth Circuit holds oral arguments. Lambda Legal argues the ban is driven by discrimination, not military necessity. A decision is pending.
